USE OF EMAIL SERVICES

Only Apptech, Employees, Clients, or Apptech's authorized users are allowed the use of our resources for the purposes of sending and/or relaying Email messages. Any other entity is strictly forbidden this privilege. In the event that an unauthorized user abuses our resources for the purposes of sending (whether successful or not) and/or relaying Email messages without our prior written consent, Apptech will invoice that entity for Email Relaying Fees.  Any entity that uses or causes to be used any internet domain name owned by Apptech, without Apptech's written permission, for email or any other purpose, shall be liable for the Email Relaying Fees for every email message received by any of our Email Servers whether or not the email was successfully relayed.

Email Relaying Fees

If you are an unauthorized user of Apptech’s Email relaying resources, your abuse of our relaying resources will constitute an agreement to pay Apptech’s Email Relaying Fees for those services used.  Services used will constitute services rendered and will be invoiced at the sum of $50 per Email message recipient.  Any email that contains a virus that is cleaned by our email virus scanner will be invoiced at the sum of $250 per Email message cleaned.  Failure to pay these Email Relaying fees within 30 days from our invoicing will result in legal action, and reporting to Equifax Credit Agency for the purposes of collecting these fees plus any damages that Apptech has suffered because of any loss of business and/or business services associated with your use of our Email sending and/or relaying.  Apptech will also contact the ISP from which the e-mail was sent and work with them in arranging the suspension of your account.
